Welcome to CoralPay Technology (Nigeria) Limited (“CoralPay”). 

This Privacy policy between the CoralPay (RC No. 634364) of 152A, Prince Ade Odedina Street, Victoria Island, Lagos State, Nigeria (“Company, “our” “us” “we”) and you, constitutes our commitment to your privacy on our records, websites, platforms, and premises (“platform”). 

We respects your privacy and is committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you navigate, visit or use our platform (regardless of where or how you navigate, visit or use it from) and tell you about your privacy rights and how the law protects you. 

Purpose of this privacy policy

This privacy policy aims to give you information on how CoralPay collects and processes your personal data through your use of this platform, including any data you may provide through this platform.

This Privacy policy describes your privacy rights regarding our collection, processing, use, storage, sharing and protection of your personal data. It applies to our website and all database, applications, services, platforms, tools and physical contact with us, regardless of where, how you access or use them. 

This platform is not intended for children and we do not knowingly collect data relating to children.

It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

Upon access to our platforms or use of our services, content, features, technologies or functions offered on our website, platforms or visit any of our offices for official or non-official purposes (collectively the “CoralPay Services”), or continuing to visit, navigate or use this platform, you acknowledge and confirm the acceptance and consent to this Privacy policy. This privacy policy also governs the use of CoralPay Services, as pertaining to the Service data, and or collaboration projects by our users and stakeholders, unless otherwise agreed through a valid written contract. 

We may amend this privacy policy at any time by posting a revised version on our platforms or placing such notice at conspicuous points at our office facilities. The revised version will be effective after publication.

On proactive measure and perspective, we have appointed a data protection officer (DPO) who is responsible for overseeing questions in relation to this privacy policy. You have the right to make a complaint at any time to the National Information Technology Development Agency and Nigeria Data Protection Bureau- the regulators for data protection. We would, however, appreciate the chance to deal with your concerns before you approach the regulator, so kindly contact us in the first instance. 

Changes to the privacy policy and your duty to inform us of changes

We keep our privacy policy under regular review. 

It is important that the personal data we hold about you is accurate, up-to-date, and complete. Hence, we require that you ensure all your personal data, at all times, is accurate, up-to-date and complete to enable us comply with regulatory requirements and extant applicable laws.

How long will you use my personal data for?

We will only retain your personal data for period of seven years and as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, reporting, tax, accounting or other requirements.

Anonymized statistical data: When you use our services, we may create anonymized statistical data from your data and usage of our services, including through aggregation. Once anonymized, we may use it for our own purposes or for that of our partners/affiliates, such as to provide and improve our services, to develop new services or product offerings, to identify business trends, and for other uses further to our business and corporate interest.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. 

Transfer of this Contract 

We can transfer our rights and obligations under these terms to any third party.

Indemnity

You hereby agree to fully indemnify and hold us harmless from and against any and all claims brought by a third party resulting from the collection, use and or processing (or otherwise) of your data and in respect of all costs, actions, losses, claims, proceedings, damages, expenses (including reasonable legal costs and expenses), or liabilities whatsoever suffered or incurred directly or indirectly by us in consequence of such collection, usage and or processing or your breach or non-observance of any of these policy (for example, but not limited to ensuring that your personal data is accurate, up-to-date and complete).

Which country's laws apply to this Policy?

Please note that the terms of this policy, its subject matter and its formation (and any non-contractual disputes or claims) are governed by the laws of the Federal Republic of Nigeria. You and we both agree to use all reasonable endeavors to settle any dispute or difference of opinion between them, arising from or in connection with this policy amicably through mutual discussion. However, if such cannot be amicably resolved between the Parties within ninety (90) business days after the occurrence of such dispute, we and or you may refer such dispute to mediation upon giving the other party 15 (fifteen) days written notice. The dispute will be submitted to and decided by Mediation at the Lagos Multidoor Courthouse.

LAWFUL BASIS

Data Portability means the ability for data to be transferred easily from one IT system or computer to another through a safe and secured means in a standard format

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of Contract means processing your data where it is necessary or in contemplation for the performance of a contract to which you are a party or to take steps at or your request before/after entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

YOUR LEGAL RIGHTS

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction or right of rectification of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected or completed, though we may need to verify the accuracy of the new data you provide to us.

Right to be forgotten or Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. 

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: 

Right to Data Portability or Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Provided that this right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you.
